can not update pacman on fresh install

just installed arch on a disk install and when i go and do pacman -Syu it asks me to upgrade pacman first. no problem, I hit yes and it starts retrieving the files. heres where it goes south. it failed to get curl, then at the end said errors happend no packages updated. so i hit pacman -Syu again, same message. I hit yes to upgradeing pacman, it checks for package integrity, done. then it checks for file conflicts. done, but then an error pops up that it fail to commit transaction due to conflicting files. heres what it reads:

error: failed to commit transaction (conflicting files)
    libc: /usr/bin/tzselect exists in filesystem
    libc /usr/sbin/zdump exists in filesystem
    libc /usr/sbin/zic exists in filesystem
errors ocurred, no packages were upgraded

    any help welcome

No that's what you have to do but Arch just had a file system change that needed manual intervention. When I did it I still had to select no and update the file system first.

    rm /usr/bin/tzselect
    rm /usr/sbin/zdump
    rm /usr/sbin/zic
