This has been going on for a while. His wife Nina went missing and there is some circumstantial evidence that points back to Hans being involved in her disappearance. they live in California, in that state its possible to get a conviction without a body in certain cases. For the most part he was the last person to see her alive so anything is possible.

Thank you for bringing up the case:
These things tend to get forgotten, if there is not much action going on on the actual scene.

I did study all the articles I was able to find about it, a few weeks ago.

And I do not agree with the fact, that a lawyer is no longer loyal to his client if he for one thing is in jail, but for the other thing cannot pay him anymore.

Mister Reiser is in need for more support and help.

And the Linux-community should stick more together in this matter and also give some clear and unmistakable statements to the public, to the court, to the press, and so on.

If this man does need more money for a reasonable defense, he should get that.

In this case, nothing is lost, and all hope is still intact.

For what mister Reiser is accused of for have done, there is no evidence that is of any good or could withstand as a sufficient proof/evidence.

Inquiries from the authorities, specially what concerns the family of his wife in Russia, are not done properly.

It will only be a short matter of time, till mister Reiser will have a stronger and better position in this case. And everybody is invited to help force the pace of what is taking place.

A man can be kept like this in prison for a while, but after a while this will get unsustainable. And will no longer be able to be adhered/to adhere.

It will also not be longer tolerated by people who have been quiet up and till now, and that had not made or stated their opinion. Much more people will speak and protest.

So right now, we will keep our fingers crossed, and follow/watch how tings will change day for day for the better for this man, and change more to what justice is meant to be.

The community should stick together i agree but i don't think it has something to do with this kind of personal problems , the community shouldn't be a part in any way in any conflict .

Hello aliov.

Here we have a man in a awkward situation.

A man that actually is not allowed to be arrested in jail, according to the facts.

A man that is supposed to be free.

It is a specific situation.

One one side, we have mister Reiser, on the other side stands the Linux-community that should be more effective and efficient about his problem.

I mean, that Hans Reiser does need the Linux-community most now.

To get him out of prison. Yes, this is our duty.

It is probably a financial problem: You have enough money for the right lawyer, you get out of prison, and you are a free man.

Bring the money together, find the right lawyer: That is what is to do.

Actually not much more to say, right now, as just get going and be active, for a great man. For a man that truly deserves our attention, time, energy and money.

It is possible, oh yes. And once we get started, all will run pretty fast, and people will wonder and be surprised.

If a law-system is not capable of putting the facts right, and acting in the best way, than other parties must clarify the facts and so that that law system has to change its strategy. The Linux-community, for example, is such a party/group.

It is indeed a question, that might come to be answered in a "moment of truth".

- But what is, if everybody's common sense, meaning also that of the authority's, inclusive the judges, have to conclude, that this "moment of truth" is most unlikely to ever appear/happen:

Then, you must let the man free. No matter, what the truth is. There is no one, that can come up with evidence that can document the truth.

In such a case a court should have no other choice than to speak out a presumption of innocence, which does result in the final discharge of the prisoner Hans Reiser.

We would like to have him back.

We got O.J. Simpson back: We can get Hans Reiser back.

The facts that speak for a release of Hans Reiser, are more numerous than those few poor ones that O.J. Simpson probably had.

If you want to call a man a murderer, you have to explain why, and that explanation has to be based on proper evidence. If there is no such evidence, you better not call the man a murderer.

And despite that: And here I address myself to Mister President of the United States of America, and to the governor in charge of the case:

The man who I am talking about, is more useful as a free man, not only for America, but for the whole world.

You just can't be as creative and productive in Jail...

- Why do I speak this way? Is this the way how to speak? -Yes, it probably is. I think these are facts that must be outspoken and heard. Because we do think economically and in ways of how to be able to profit most.

There are also situations, where the issues of profit and benefit take priority over other issues.

Excuse me, for this way of talking. But reality shows, that such priorities do decide if some endangered prisoner or other person in custody can save his head and get released, or not.

It is not my stile, but I am sure, that this is the way they sometimes handle it, when no other facts have enough weight.

So, now I spoke it out: And it was hard to do. What I just described, has of course nothing to do with justice. But I said it, because I know, that it is not always justice or a judge that makes the final decision.

Final thoughts:
So if you read these last two posts of mine, we see, that we do have quite a lot of heavy weighing facts, that speak for the final discharge of the prisoner.

The one fact has something to do with law, and the other fact has, nevertheless, nothing to do with justice.

Again, it is not only my duty, but also my great honor, to encourage many people to complain against the imprisonment of unguilty man.

100'000 men and women are enough, to get Hans Reiser free, by stating that they do not agree with his imprisonment.

Why?

Because the existing facts for keeping him in prison, do not have much weight, and the mentioned amount of protesting people would simply bring the scale to not only be very unbalnaced, but even to fall over.

Dear Hans, if you come around to reading this:

You don't have a lucky hand for choosing things: You chose the wrong wife, some wrong friends, and last thing you did, was also choosing the very wrong lawyers, who just "left you in the rain", when you where not anymore able to pay them. They "let you get soppy", not supporting or defending you anymore, and it is at least time, to "get your clothes dry". And of course, to get your honor restored.

You seem to be a very likable man. And worth every minute of our precious time, to help you.

Now back to all readers:

It is the right of free speech, to tell a law system, that it is acting very wrong.

Hans is only in prison, so that some other people involved in this matter, can look good.

We are not so interested in that those people look good while doing their jobs.

We want Hans Reiser to look good. He is very strong, and keeping in good shape.

There are cases that never can get solved, meaning that you just won't find the people that are responsable for a criminal act. In those cases you can not keep some suspect person in prison, just because there is no one else found, that can stand better for a better match of a offender.

Hans does not match. There is no propper match.

A suspected killer, should not be a killer, according to the law.

We have to draw the line, somewhere, or else that law system will appear more like a system of disposal. A random system. And that is not at all, how law should be. Realizing this fact, not many citizens of the United States of America would agree with such a law system.

A suspected killer witout enough evidence speaking for a possible killing, has to undoubtfully result into a
a presumption of innocence, which does result in the final discharge of the suspected killer.

That is law, but not what it happening within the law system that is keeping Hans Reiser imprisoned.

Judges not acting correctly while doing their work, are doing wrong themselfs.

I would like to close this case in a few months, and hope, that the American authorities, including Mister President, will handle according to my point of view.

Further, I want Mister President to speak a word that shall have a higher priority than those of the judges in charge of the case.

A high amount of voters will then kindly vote for Mister Bush, looking at it as "payback time".

This looks like a smal case now, but we should not underestimate it, because it will for sure get to be a much bigger issue. A important issue within the american history, where no President can keep aloof from what is going on in this matter.

Even if I will have to show up in blips.tv, I will do everything I can, and hope to have many followers.

I can show, who I am, and what I can do. For a single man, or for a whole country.

Anybody there, who would like to present videos about this issue? That would be great. I have seen many very talented speakers. Why not put in some energy, for a good cause?

Well, if it is me, who will have to do that part of the job, I could sent the videos in, but maybe someone else would like to do it instead of me, and I could guide him a little.
