hiya scumpoozie, Welcome to Linux Forums.
I'm sure it is perfectly legal to sell Linux CD/DVD's on Ebay, you can get them from a lot of different places like:
Linux-Disks.com - Buy Linux on Disk - CDROM and DVD. Get Open-Source software on CD and DVD - New releases. Low prices.
I do not respond to private messages asking for Linux help, Please keep it on the forums only.

There's no worry. You can't really pirate Linux, as it's all open source.

This is one of the reason why I think it is so necessary to differ between Linux and the operating system.

While the kernel, Linux, is both Free Software and Open Source, not every distribution is. For example, the Linux distribution "IMagic OS" is highly proprietary and it would be an infringement to sell copies.

On the other end, there are completely free distributions like gNewSense--allowing and even encouraging their users to built a business around them.
