Well this is nothing new, since now you could ask a company for specs for a piece of hardware. What is new is that kernel team itself is doing it. I do have one concern. What if some developer has to sign a NDA to look at the spec and the resulting code can only be understood by looking at the spec (thereby needing a NDA). Is that really free or open source software? Sure that is ok for the linux kernel, but what about *bsd, hurd, or someone unknown free kernel of the future. They are still screwed.
The program must include source code, and must allow distribution in source code as well as compiled form. Where some form of a product is not distributed with source code, there must be a well-publicized means of obtaining the source code for no more than a reasonable reproduction cost-preferably, downloading via the Internet without charge. The source code must be the preferred form in which a programmer would modify the program. Deliberately obfuscated source code is not allowed. Intermediate forms such as the output of a preprocessor or translator are not allowed.

As far as I know their's(sadly) only one official kernel hacker agreeing that these modules would be derived from the kernel.
I was was wondering(and googling) the same thing though.
Since they mentionned they will include them in the official kernel tree, I assume the will need to be GPL'd.

Is the "(=<" at the beginning supposed to show how depressed you'll be after trying to figure it out, or (if you look at it the other way around) the creator of the language with an evil grin, thinking of how much they've made people suffer?
