Get a refund for unused copy of windows
Hi all , i bought a laptop today for my brother , he's a Linux user , and the laptop comes with windows vista crash capable , so i'm trying to get a refund ,the provider is Vaio in Geneva, and things seems to go well ,but i would like to share this with other people in the site who manage to get a refund , to collect information as much as possible since they didn't tell me the final answer yet. what happened when i call them ( shortly is the following) .
1) - I don't accept the license of windows and the license said that i have to contact the provider of the machine to get a refund .
2) - Why you didn't accept the license
1) - because i can't develop code licensed under GPL , and there is a lot of restriction in the license ( i want your suggestion please ).
2) - But the OEM doesn't allow us to make a refund for you .
1) - why if i boot my system a popup panel appear and asks me to accept or not the license if i have to do before .
2) - yes, when you buy the laptop it comes by default with vista and can't be separated .
1) - they didn't tell me that and also i didn't sign any paper related to that .
2) - Hold a moment please .
1) - okay waiting
2) - i asked my Bos and he told me this is not possible
1) - well you did for my friend since 1 year , i can tell you how's !
2) - know the politics of Microsoft changed
1) - i don't care the license is clear if i don't accept it i can get a refund from you .
at this point the guy took my phone number e-mail address and my address and he tell me he's going to investigate more and he'll call me the next day.
Well , i hope i'll win at the end , but really i'm ready to go to the end , even for judgment !
I've read a lot of articles about the best way to get a refund , but please share with me your experiences and your idea .

It's been discussed here before, but it was quite awhile back. You might find the previous discussion with a forum search, but I'm not sure.

This point is not legally clear. One point of view is that you accepted to buy a package (computer+OS) and there is the invoice that confirms. Another point of view is that the seller could not have the right to sell a licence which the customer cannot verify.
Well I have read about customers that took their money back, but you must insist.

If you have conciliateurs de justice in switzerland (like here in France) ask at the municipality to meet him.
Search on the web to find cases of refund of money (I think Dell gave money back sometimes) so that you can insist that this is something that already happens (your seller or the conciliateur may not know it )
Finally, if your seller is always negative, tell him you will inform the linux community not to buy from them.

I'm leaving in France very close to the Border , but i don't think the concillateur de justice will help me if i bought something from Geneva , but sure there is once similar service in swiss.
I'll not resign easily, my friend have done the refund from them since one year so there no point to don't refund me . as i said i'll go to the end with them , just to say that this is not fair .

This is what i'm following and also Getting a Windows Refund in California Small Claims Court | Linux Journal , the nice thing it's to be very quite and polite with them.

I understand how people have an issue with this for laptop PC's, but as far as desktops go, my preferred strategy is to build the computer from scratch. I guess it ends up being a little more expensive, but not that much, and the price is far worth the added tuning and customization you receive.
In fact, my favourite strategy is taking an old computer and upgrading it. If you put as much money in an old computer as you would have buying new, you can get quite a bit more bang for your buck by recycling a tower and a few cd-rom drives. Even more so if the old motherboard is still up to par.Living the digital dream....

Back, so i receive finally a respond from them but not an answer, i'm completely surprised about their answer it's not for my question , they start telling me in the mail (in French ) the history of sony in the market and the why the computer comes with windows installed to provide the customer's a laptop ready to use. but nothing related to my question even the work refund doesn't exist in the mail ! they didn't tell me at the end of the mail that's why we can't provide you a refund , they only say regards and greetings .
So i called them directly and i got the same guy, i explain ,about the mail, to him this is not an answer for my question , and i told him i'm not the first one in the world how wants a refund , and also the name of the guy who did the refund from them . after telling all that and also about the Linux community , he told me he's going to inform his Boss again about these information and send me a mil on monday , so let's see .Linux is not only an operating system, it's a philosophy.
