The command for finding the GRUB version:
Code:grub-install -v
oz

The default for Mint 9 is Grub2.
But go ahead and double check that, just in case

Thanks guys for the reply's. Here is what came up:
grub-install (GNU GRUB 1.98-1ubuntu5-1mint2)
Can I assume this is grub and if so should i update it?

That's considered to be GRUB2 even though it's still pre-GRUB2. The GRUB devs are still working on it but they say it's usable enough for most users.
You can update if you wish. Sometimes, the GRUB2 devs make changes that cause GRUB to not work the same, so your system might not boot, but I'd imagine that the Mint packagers have fixed any such issues. Still, there is always some bit of risk when updating packages. If it were me, I'd upgrade it if there is a new Mint package available for it. You'd upgrade it the same as any other Mint package.oz

GRUB Legacy is 0.97 and all version after that ( starting from version 1.9x ) are considered as GRUB2 only.
There is no need to upgrade GRUB2 manually. Package Manager will take care of that.It is amazing what you can accomplish if you do not care who gets the credit.
